Cilj izobraževanja

Veliko sodelujete s samostojnimi podjetniki, študenti itd. – na kaj je pozoren inšpektor, ko ugotavlja, ali gre za obstoj delovnega razmerja?

Ni nujno, da opravljanje dela vedno zaupamo samo svojim zaposlenim na podlagi sklenjene pogodbe o zaposlitvi, temveč lahko z osebami sklepamo različne oblike pogodb civilnega prava, in sicer glede na status, ki ga ima oseba, ki bo delo izvršila – od podjemnih do avtorskih pogodb, do raznih pogodb o poslovnem sodelovanju, predvsem s samostojnimi podjetniki. Na seminarju bodo predstavljene vse oblike pogodb ter nasveti, katero vrsto pogodbe je potrebno skleniti v posameznem primeru. Predstavljene bodo tudi sankcije v primeru sklenitve neustrezne pogodbe, in sicer od potencialnih tožb osebe, ki opravlja delo, do glob, ki jih lahko izreče inšpektor za delo.

Delovni inšpektor ve kje in kako poiskati nepravilnosti

Delodajalci nenamerno, včasih pa tudi namerno delajo zgornje napake. Pri tem se ne zavedajo, da delovni inšpektorji uporabljajo izjemno dober postopek za prepoznavanje elemenotv delovnega razmerja in ekonomsko odvisnih oseb v vašem poslovanju. Na kratko; če mislite, da boste lahko ukanili inšpektorja, se krepko motite. Zgovoren je podatek, da je v povprečju ugotovljenih več kot 200 tovrstnih kršitev letno.

Visoke kazni za kršitelje

Kršitelji morajo tako zaposliti »delavca« in plačati finančne obveznosti iz delovnega razmerja za nazaj. Globa lahko znaša od 3.000,00 EUR, pa vse do 20.000,00 EUR, lahko pa pride tudi do kazenske ovadbe.
