Razlogi za naročilo spletnega tečaja

Nova Direktiva (EU) 2023/970 prinaša zavezujoče ukrepe za preglednost plač in izvrševanje načela enakega plačila za enako delo ali delo enake vrednosti. Dobili boste konkretne napotke, kako se skladno pripraviti, zmanjšati pravna tveganja ter izboljšati zaupanje in pravičnost v plačni politiki.

Podrobnejši program spletnega tečaja

1) Uvod v Direktivo (EU) 2023/970

  • Namen, cilji in pravna podlaga v EU pravu (PDEU 157, Listina EU).
  • Časovnica: sprejeta 10. 5. 2023, v veljavi od 6. 6. 2023; rok prenosa v nacionalno zakonodajo do 7. 6. 2026.

2) Področje uporabe in zavezanci

  • Velja za delodajalce v javnem in zasebnem sektorju ter za vse oblike dela (nedoločen, določen, skrajšan, pripravništvo, ipd.).
  • Upošteva se tudi položaj kandidatov za zaposlitev.

3) Enako plačilo in vrednotenje delovnih mest

  • Kaj pomeni »enako delo« ali »delo enake vrednosti« ter objektivna, spolno nevtralna merila (zahtevnost, pogoji, odgovornosti, znanja/kompetence itd.).
  • Vzpostavitev plačnih razredov/razponov in metodologije vrednotenja DM (tudi, ko ni panožne KP).

4) Preglednost plač pred zaposlitvijo (čl. 5)

  • Kandidati morajo prejeti podatek o začetnem plačilu ali plačnem razponu za delovno mesto.
  • Prepoved spraševanja o trenutnih/preteklih plačah kandidatov.
  • Spolno nevtralni nazivi delovnih mest in nediskriminatoren postopek zaposlovanja.

5) Politika plač in napredovanja (čl. 6–8)

  • Delavcem mora biti omogočen preprost dostop do objektivnih, spolno nevtralnih meril za določanje ravni plač in napredovanja.
  • Letno obveščanje delavcev o pravici do informacij; obveznost odgovora v dveh mesecih od zahteve.
  • Pravica delavcev do razkritja lastne plače za namen uveljavljanja enakega plačila; prepoved pogodbene prepovedi razkrivanja.
  • Zagotoviti dostopnost informacij invalidnim osebam (format, velikost pisave, kontrast ipd.).

6) Pravice do informacij (čl. 7)

  • Delavec lahko pisno zahteva: (a) svojo raven plačila in (b) povprečne ravni plačil po spolu za kategorije enakega ali enakovrednega dela; odgovor v 2 mesecih (možno tudi preko predstavnikov delavcev ali organa za enakost).

7) Poročanje o plačilnih vrzelih (čl. 9)

  • ≥250 zaposlenih: prvo poročanje do 7. 6. 2027 (za leto 2026), nato vsako leto.
  • 150–249: prvo do 7. 6. 2027 (za leto 2026), nato na tri leta.
  • 100–149: prvo do 7. 6. 2031 (za leto 2030), nato na tri leta.
  • Možna nižja meja za slovensko zakonodajo. Poročajo se tudi podatki za zadnja 4 leta na zahtevo organov.

Vsebina poročanja (primeri metrik):

  • skupna plačilna vrzel (povprečja in mediane),
  • vrzel v dopolnilnih/spremenljivih delih plače,
  • deleži prejemnikov dopolnilnih delov po spolu,
  • razmerja spolov po kvartilnih plačnih razredih,
  • vrzeli po kategorijah delavcev (osnovna in spremenljiva plača).

8) Skupna ocena plačil (čl. 10)

  • Obvezna, kadar je v kategoriji delavcev vrzel ≥5 %, je ni mogoče utemeljiti z objektivnimi spolno nevtralnimi merili in je delodajalec ne odpravi v 6 mesecih od poročila; pripravi se skupaj s predstavniki delavcev.

9) Izvrševanje, pravna sredstva in nadzor

  • Obrnjeno dokazno breme – delodajalec dokazuje, da ni diskriminacije.
  • Pravica do polne odškodnine (tudi zamujene priložnosti in obresti); kazni morajo biti odvračilne.
  • Povezava z ZDR-1 (prepoved diskriminacije, enako plačilo M/Ž; globe)

Cilji spletnega tečaja

  • seznanili se boste z vsebino in ključnimi zahtevami direktive (EU) 2023/970 na področju enakega plačila za enako delo ali delo enake vrednosti;
  • spoznali boste nove obveznosti, ki jih bo treba kot delodajalec izpolnjevati, ter razumeli pravne posledice neskladnosti;
  • naučili se boste, kako vzpostaviti pregledno in pravično plačilno politiko, vključno z vrednotenjem delovnih mest in merili za napredovanje;
  • prepoznali boste primere neposredne in posredne diskriminacije pri plačilu in se naučili, kako jih odpraviti;
  • pripravili boste na postopke nadzora, poročanja in uveljavljanja pravic zaposlenih v skladu z novo zakonodajo.
