Celotno izobraževanje bomo podkrepili s praktičnimi primeri, najnovejšo pravno prakso ter novostmi, ki so v pripravi na tem področju.
V zadnjem delu boste prejeli odgovore na vprašanja, ki jih tekom izobraževanja niste prejeli, zato vas vabimo, da nam že pred izvedbo pošljete za vas zanimiva vprašanja, ki niso zajeta v programu.

Cilj izobraževanja

Kako pravočasno preprečiti nastanek mobinga v organizaciji?

Zakonodaja prepoveduje vse oblike nasilja na delovnem mestu, vendar ne opredeljuje, kako je te oblike mogoče preprečiti ali omejiti.

To je naloga delodajalcev, ki moramo interno poskrbeti za:

  • preventivne ukrepe omejevanja in preprečevanja mobinga in drugih oblik nasilja,
  • opredeliti postopek interne prijave (komu podati prijavo in v kakšni obliki)
  • opredeliti postopek ugotavljanja utemeljenosti podane prijave
  • opredeliti sankcije za kršitelja
  • vzpostaviti delovno okolje, v katerem noben delavec ne bo izpostavljen spolnemu in drugemu nadlegovanju ali trpinčenju s strani delodajalca, predpostavljenih ali sodelavcev.

V ta namen mora delodajalec sprejeti ustrezne ukrepe za zaščito delavcev pred spolnim in drugim nadlegovanjem ali pred trpinčenjem na delovnem mestu (povzeto po čl. “Kdo je izumil mobing”, Andreja S. Koderman).

Sankcije in dokazno breme

Če delodajelec ne zagotavlja delavcem delovnega okolja v skladu s 45. členom ZDR, mu po 7. alineji 229. člen ZDR, lahko grozi kazen od 3.000,00 do 20.000,00 EUR. Prav tako je dokazno breme na strani delodajalca. V primeru tožbe delavca mora delodajalec dokazati, da je znotraj organizacije izvedel vrsto aktivnosti preprečevanja tovrstnega nasilja v organizaciji. V nasprotnem primeru je delodajalec odškodninsko odgovoren delavcu – žrtvi mobinga, po načelih civilnega prava.
