Podrobnejši program delavnice

1. del: Kdaj govorimo o napotenih delavcih in kdaj o službenem potovanju (delovnopravni vidik)?

Prvi del vodi strokovnjakinja za delovnopravno zakonodajo Andreja Samec Koderman.

  • Zakonska podlaga napotitve delavcev.
  • Pravice delavcev do odklonitve napotitve.
  • Kaj vse moramo preveriti, preden z delavcem sklenemo pogodbo o napotitvi (tujo delovnopravno zakonodajo, delovna dovoljenja, kolektivne pogodbe, druge zakonske omejitve ali obveze)?
  • Postopek napotitve delavca (pogodba o napotitvi, sprememba podlage zavarovanja, A1 obrazec).
  • Katere pravice delodajalec delavcu zagotavlja po slovenski zakonodaji in pod katerimi pogoji?

2. del: Obračun plače delavcem, napotenim na delo v tujino (davčni vidik)

Drugi del vodi strokovnjakinja za davčno zakonodajo Irena Kamenščak.

  • Pravila zakonodaje, ki ureja prispevke za socialno varnost pri določanju osnove za njihov obračun.
  • Vprašanje rezidentskega statusa.
  • Pravila slovenske dohodninske zakonodaje pri obračunu plače napotenega delavca.
  • Uporaba mednarodnih konvencij o izogibanju dvojnemu obdavčevanju in uveljavljanje ugodnosti po KIDO postopkih.
  • Metode za odpravo dvojne obdavčitve
  • Možnosti izplačila neobdavčenih povračil stroškov.
  • Prikaz obračuna plače in izpolnitve REK obrazca.
  • Na kratko o stroških napotitev in transfernih cenah.
  • Izkušnje iz prakse – stališča davčnih inšpektorjev v mejnih situacijah. .

Pomembno: Seminar – Napotitev delavcev v tujino ne pokriva detaljnih interpretacij lokalne zakonodaje tujih držav. Boste pa prejeli natančne informacije kam in na koga se v posamezni državi obrniti.

3. del: Predstavitev zanimivih praktičnih primerov

Zadnji del bo namenjen vprašanjem udeležencev in prikazu praktičnih primerov.

  • Najpogostejše dileme delodajalcev pri napotitvi delavcev.
  • Kako lahko z ustrezno sistemizacijo podpremo proces napotitve delavcev?
  • Kako obračunati stroške, ko se delavec samoiniciativno predčasno vrne domov?
  • Odgovori na vprašanja udeležencev.

Cilj izobraževanja

Kako se v praksi uveljavlja nov zakon?

Slovenija je že marca 2017 sprejela nov Zakon o čezmejnem izvajanju storitev (ZČmIS), njegova uporaba pa je bila odložena do 1. januarja 2018. Zato bomo na seminarju posebej spregovorili kako in na kakšen način se zakon uveljavlja v praksi, kje so težave in na kaj moramo paziti, da bomo na varni strani zakona.

Na seminarju bomo soočili strokovnjakinji s področja delovnopravne in davčne zakonodaje. Tako boste dobili odgovore na vprašanja in razjasnili dileme, pri katerih delodajalci nehote kršimo zakonodajo, saj si jo zaradi zapletenosti postopkov pogosto razlagamo po svoje.

Podrejeni položaj delodajalca – ostanite na varni strani zakona

Delovna in davčna inšpekcija se ne odziva zgolj na prijave, temveč po naključnem ključu obiskuje vsa podjetja. Delodajalec je v odnosu do inšpektorata v podrejenem položaju, saj je breme dokazovanja na njem.

V primeru, da inšpektor najde nepravilnost, vas v najboljšem primeru čaka veliko dela in vloženega časa ter denarja za odpravo napak, v najslabšem primeru globa in v nekaterih primerih tudi kazenska ovadba.

Siva območja v zakonodaji na področju napotitve delavcev v tujino

Zaradi včasih nedorečene zakonodaje na omenjenih področjih, se pojavljajo različna mnenja s strani inšpektorata, davčne uprave in ministrstva. Pojasnili bomo za katere primere gre in kako v njih, kot delodajalec, ravnati.

Celotno izobraževanje bomo podkrepili s praktičnimi primeri najnovejšo pravno prakso ter novostmi, ki so v pripravi na tem področju.
